Stephen M. Breitstone and Jerome M. Hesch will be speaking at the NYU 82nd Institute on Federal Taxation Conference on Thursday, October 26, 2023 in New York, NY and Thursday, November 16, 2023 in Berkeley, CA. Attorneys Stephen M. This panel focuses on the income and transfer tax issues pertaining to the change or modification of a grantor trust during the settlor’s life or upon death. The presentation explains how the fundamental transfer tax principles and fundamental income tax principles interact when a grantor trust becomes a separate taxpayer for income tax purposes. The presenters then explore basis issues under Section 1014 as well as additional complex situational issues involving conversions of grantor trusts including installment sales to intentionally defective grantor trusts.
