Reminder that owners of rental units with children under six who have resided in those units since August 9, 2020, must complete XRF inspections of those units by August 9, 2021.
Under Local Law 31, owners must have XRF inspections of all surfaces in every unit conducted by a third party EPA certified inspector/ risk assessor to determine whether lead paint is present. This must be completed within five years of the effective date of the law (by August 9, 2025) OR within one year of a child under 6 residing in that unit, whichever is sooner. Therefore, where a child under the age of 6 has resided in a unit since August 9, 2020, an XRF must be completed for that unit by August 9, 2021. Records of the XRF testing must be kept for 10 years.
